Building Regulations

Building Regulations are a set of construction standards laid down by Parliament. Building Control is responsible for ensuring that buildings conform to these requirements which include standards on health, structural stability, fire safety, energy conservation and accessibility.

Types of Applications
Building Control can receive one of three types of applications - Full Plans, Building Notice or Regularisation. The majority of applications received tend to be either Full Plans or a Building Notice. Anyone intending to build, alter or change the use of a building is required to submit a completed Building Regulation Application Form. The same form is used for all three types of applications. Regularisation
Regularisation Certificates are provided to individuals who have undertaken building work without prior approval from Building Control. Until recently Building Regulations made no provision for the approval of unauthorised work but this created problems in conveyancing of property. To address these problems the Building Control Regularisation procedure was introduced enabling unauthorised work to be certified by Building Control and bringing it in line with the relevant regulatory requirements. Application Fees
Works which come within the remit of Building Regulations attract a fee. The only exemptions are where the works are exclusively for a person with a disability or where the works are exempt form control. The scale of fees is prepared by the Department of Finance and Personnel and defined in legislation. The fees are increased periodically as the Department deems appropriate.

Site Inspections
Building Control surveyors undertake site inspections at various stages of works to ensure compliance with Building Regulations. Same day inspections can be arranged when notification has been received before 10.30am.
